CAMPER HIRE RENTAL AGREEMENT

This is an Agreement between the prospective hirer and the Company to rent the motor vehicle including all accessories, tools, tyres and equipment and any replacement vehicle (the vehicle).

1. VEHICLE CONDITION AND RETURN
The vehicle is delivered to you in good clean operating condition and with the seal of the odometer unbroken. You agree to return the vehicle in the same condition (except for ordinary wear and tear NOT INCLUDING WINDSCREEN / GLASS OR TYRE DAMAGE) together with all tools, tyres, accessories and equipment to the location and on the date there specified (or sooner, if demanded by the Company). The Company may take possession of the vehicle without prior demand and at your expense, if it is illegally parked, used in violation of the law or of this agreement or if it is apparently abandoned. The Company must be notified and agree to any extension of the period of hire beyond that stated in advance of the return date and time or the vehicle will be immediately reported as stolen.

2. UNAUTHORISED AND PROHIBITED USE
Persons who must not drive the vehicle:

(a) A person who has not been identified in writing to the Company or approved by the Company in writing.

(b) A person who is not licensed for that class of vehicle.

(c) A person whose blood alcohol concentration exceeds the lawful percentage.

(d) A person who has given or for whom you have given a false name, age, address or driver's licence details.

(e) A person whose driver's licence has been cancelled, endorsed or suspended within the last three years.

(f) A person who has held a driver's licence for less than two years.

Circumstances in which and/or for which the vehicle must not be used:

(g) Outside the area of use limitations.

(h) On unsealed roads or off road conditions.

(i) To carry persons for hire or to carry any inflammable, explosive or corrosive materials.

(j) To propel or tow any vehicle, trailer, boat or other object unless the company has authorised such use in writing.

(k) To carry any greater load and/or more persons than is lawful or use in a manner for a purpose other than for which it was designed and constructed.

(l) To carry any animal or pet in the vehicle.

(m) For racing, peacemaking, reliability trials, speed trials, hill climbing or being tested in preparation for those purposes.

(n) In a dangerous manner.

(o) In contravention of any legislation or regulation controlling vehicular traffic or for any illegal purpose.


3. FINANCIAL OBLIGATIONS

Special Note: Joint hirers and all drivers are jointly and severally responsible under this agreement.

YOU ARE RESPONSIBLE FOR AND BY ENTERING INTO THE AGREEMENT YOU AUTHORISE THE COMPANY TO DEBIT THE CREDIT CARD

PROVIDED OR ANY OTHER CREDIT CARD PROVIDED (and you will pay on demand any balance) WITH THE FOLLOWING CHARGES:

(a) All rental charges.

(b) All charges claimed from the Company in respect of parking or any other traffic violations incurred during the period of hire or until such later time as the vehicle is returned to the Company.

(c) All loss or damage to the motor vehicle (including loss of use) legal expenses, assessment fees, towing and recovery, consequential third party damage, storage and company service charges where

(i) any condition of this agreement, and in particular Condition 2, or any special condition has been breached;

(ii) the vehicle is involved in a single vehicle incident(or not under the control of an authorised hirer at the time of loss) unless the Company waives such loss to a single vehicle incident liability amount (which amount will apply in addition to the standard liability charge). A single vehicle incident is defined as any incident where the vehicle suffers loss or damage as a result of an impact with any or all objects whether animate or inanimate except another vehicle which can be fully identified and all details provided.

(iii) you have left the vehicle unlocked or left the keys in the vehicle;

(iv) you have not kept the key secure and under your personal control;

(v) the underbody of the vehicle is damaged regardless of cause when no other vehicle is involved;

(vi) the vehicle is totally or partially immersed in water regardless of cause;

(vii) the interior of the vehicle is damaged regardless of cause when no other vehicle is involved;

(viii) the tyres of the vehicle are damaged other than by normal wear;

(ix) the vehicle or any third party property is damaged by driving it under or into an object lower than the height of the vehicle;

(x) you have failed to maintain all fluid and fuel levels or failed to immediately rectify or report to us any defect of which you become aware;

(xi) the vehicle is damaged by loading or unloading, other than normal wear.

(xii) your failure to secure properly any load or equipment which leads to loss caused by any part of said load or equipment.

Special note: If you have paid by use of a credit card or directed the company to bill charges to some other person, corporation, firm or organisation who or which fails to make payment when due, you will immediately pay the full amount due to the company on demand.

4. DAMAGE COVER
If you act within the terms and conditions of this agreement the company will grant damage cover (including legal costs incurred with our consent) for your benefit in respect of damages to the vehicle or third party damage other than any property owned by you (or any friend, relative, associate or passenger) or in your physical or legal control.

This cover is subject to:

(a) Your payment of the damage/loss liability charge.

(b) Your not having acted or having caused any other person to have acted in any manner which is in contravention of this agreement.

(c) Your not being covered under any policy of insurance.

(d) Your providing such information assistance as may be requested and, if necessary, authorising the company insurer to bring, defend or settle legal proceedings, but the company shall have sole conduct of the proceedings.

5. GENERAL PROVISIONS

(a) You will promptly report any incident involving loss or damage to the vehicle or loss involving the vehicle while rented under this agreement to the company location where the vehicle was hired and will deliver to the company immediately, every summons, complaint or paper in relation to such loss. Compliance with the sub-paragraph does not excuse the hirer from reporting all incidents to police or other proper authorities.

(b) You release and hold harmless the Company (and its agents and employees) from all claims for loss or damages to your personal property, or that of any other persons property left in the vehicle, or which is received, handled or stored by the company at any time before, during or after this rental period, whether due to the Company's negligence or otherwise.

(c) Except as proved by law no driver or passengers in the vehicle shall be or deemed to be the agent, servant or employee in any manner for any purpose whatsoever.

(d) The company gives no express or implied warranty except those implied by the Trade Practices Act 1974 or any other law as to the condition of the vehicle, but nothing herein restricts you from you rights and remedies under those laws. Where those laws permit the company to limit liability for breach of implied condition or warranty, the company limits liability to replacement, repair or resupply. In particular, the company is not liable for any indirect or consequential loss or damages.

(e) No right of the Company under this agreement may be waived except in writing by an officer of the company.

(f) Words used in this agreement to denote any gender shall include all genders, singular words include the plural.

6. FUEL

The vehicle must be returned with the amount of fuel equal to that at the time of the rental. If the vehicle is returned with less fuel the difference will be charged at a rate which may include a service component unless prior arrangements have been made and noted.

7. BOND
This is held subject to the terms and conditions of the contract eg when you return the vehicle your bond is returned in full if it is acceptably clean and there is no damage to it, it’s contents or any third party property. The bond covers you for the first accident. If you have another accident or the vehicle is damaged, then you will liable for a further bond. The rates and prices quoted are in Australian dollars and are subject to change without notice.

8. CANCELLATIONS
In the event of a booking cancellation the booking deposit paid at the confirmation of your booking is non refundable.  Further to this the following cancellation charges will also apply:
If cancelled 22 days or more prior to pick up an administration fee of AU$100 will apply.
If cancelled 21 - 15 days prior to pick up there is a AU$200 cancellation fee.
If cancelled 14 - 1 day prior to pick up there is a 50% cancellation fee.
There is a 100% cancellation fee on “no show”.
Vans will be rehired after 3 days if you “no show”.
No refunds are given after your hire has commenced.

9. PROBLEMS

If you have any difficulties report these immediately to GO Camper. If you incur any minor repair bills we will give you a refund (up to AU$100). Just produce your receipt at the completion of your hire. Retrospective claims above this limit cannot be recognised. All of our vehicles are covered by national RAC coverage, for your peace of mind. In a breakdown situation, follow the instructions we provide in the glove box of every van. If you have an accident, you pay any accommodation expenses. GO Camper liability extends to replacing your vehicle with a similar one.

10. SMOKING

Our vans are smoke - free zones. Please smoke outside van ONLY.

11. Short Term Rental Cleaning Fee
There is a minimum cleaning fee applicable for booking 4 days or less of AU$60. Vehicle rentals are calculated on a per calendar day basis, i.e. day of pick-up or drop-off is always counted as a full day irrespective of what time it is collected or dropped off.

12. Long Term Rental
Special conditions apply for rentals of more than 50 days. Details available on application.

13. One -Way Rental
One way rentals are available between Perth, Broome, Darwin, there is a fee applicable which will be detailed in your booking costs.

14. Restrictions


Campervans / motorhomes can only be driven on sealed / bitumen or access roads. 4WD vehicles are allowed on recognized 4WD tracks. Special terms and conditions apply for travel in the following areas: Cape York, Simpson Desert, Gun barrel Hwy, Gibb River Road, Canning Stock Route and any other area in excess of 100km from the nearest sealed road. No vehicle is to be taken into salt water, No animals permitted in vehicles. No smoking in vehicle.

Option One
Standard Excess Policy
Go Camper vehicles come with comprehensive insurance cover. A standard excess of AU$5,000.00 applies in the event of any damage to either our vehicle or third party property. A security bond of AU$5,000 will be taken. The security bond can be paid by cash, or credit card. Should the bond be paid by credit card, the amount will be debited immediately. The bond is fully refundable on return of the vehicle to the agreed location in a clean condition, on the agreed date, with no damage to the vehicle or third party property, the toilet cassette and waste water tank has been emptied and no items are lost or damaged.

Option Two
Excess Reduction
AU $20.00 per day, will reduce the excess for any damage to either vehicle or third party property to a maximum of AU$2,000.00. The bond of AU$2,000.00 can be paid in cash, or imprint of credit card: This is fully refundable on return of the vehicle to the agreed location, on the agreed date in clean condition, with no damage incurred to the vehicle or third party property and the toilet cassette and waste water tank has been emptied and no items are lost or damaged. Maximum charge 50 days.

Option Three

Excess Reduction

AU $30.00 per day will reduce the excess for any damage to either vehicle or third party property to a maximum of AU$500.00. The bond of AU$500.00 can be paid in cash, or imprint of credit card: This is fully refundable on return of the vehicle to the agreed location, on the agreed date in clean condition and the toilet cassette and waste water tank has been emptied and no items are lost or damaged. Maximum charge 50 days.

NB: Go Camper are not responsible for any currency fluctuations.
The renter is fully liable for replacing or repairing damaged windscreens and tyres.
A Cleaning fee of AU$60 is applicable when booking four days or less.

Taxes and Local State Tax

All charges include 10% GST and 2% Local State Tax. All rates and conditions are subject to change in accordance with changes in government taxes.

In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.

Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
